The SAVE (Safeguard American Voter Eligibility) ACT is also known as U.S. Senate bill S4292 and U.S. House of Representatives bill HR 8281. Here’s what it is designed to accomplish. 

  • Amends the National Voter Registration Act (NVRA, 1993), to require states to obtain documentary proof of U.S. citizenship and identity – in person – when registering to vote in a Federal election. 
  • Ensures only US citizens are registered to vote in federal elections.
  • Requires states to establish a program to remove non-citizens from existing voter rolls.
  • Empowers U.S. citizens to bring civil suits against non-compliant election officials.
  • Provides for prompt updating to any guidance associated with the SAVE Act.

WHY Is it Needed?

  • It is estimated that 10-27% of the 20 million non-citizens of voting age in 2022 are illegally registered to vote. This is enough to tip the vote in U.S. Congressional, Senatorial and Presidential elections.
  • Biden’s Executive Order 14019 requires all federal agencies to promote voter registration forms and distribute voter registration forms.
  • The Help America Vote Act (HAVA) requires that states have to verify identity of voters before they can be registered to vote in a federal election, but you don’t have to be a citizen of the US to get a license or a SS number.
  • Currently there is no mechanism to assure that everyone voting is a citizen. The states don’t have a way to confirm citizenship.
  • The Supreme Court ruled that states cannot require documentary proof of citizenship. This is in effect until Congress changes it.
