Well, here we are, a little over a month since my March 30 message to you, and we’ve added about $6.7 trillion to the national debt, thrown 30 million Americans out of work, pretended the Constitution doesn’t exist, and seen an incredible explosion of tyrannical, unconstitutional behavior by a large number of elected officials from both major parties at all levels of government.
Are you as livid as I am? The governmental response to COVID-19 was initially established to ensure hospitals would have time to get prepared and not be overwhelmed. We passed that point long ago, and now it’s all about greed, power, and picking economic winners and losers based on politics. The situation is disgraceful.
First, with respect to COS and our resolutions, I am cautiously optimistic that the fiscally insane actions taken by Congress will stimulate an increased interest from the Pennsylvania General Assembly in our resolution.
This is another significant action in support of individual freedom and liberty the legislature can take that cannot be stopped by Gov. Wolf. If the resolutions are not passed by the end of 2020, we will have to start over in 2021 at the committee level.
With respect to the lockdown situation in Pennsylvania, attached is an email I sent to all members of the House and Senate Republican caucus members last week.
It is apparent we have discovered a major defect in the Pennsylvania Constitution. No governor should be able to do what Gov. Wolf has done to the citizens of Pennsylvania. Any emergency declarations that could severely impact economic activity across the entire Commonwealth must be made by (or can be revoked by) the General Assembly.
I expect there will be an effort to develop an amendment to the Pennsylvania Constitution later this year. The process takes some time but can be completed whether the Governor approves of it or not. The final amendment language–after passage by both chambers of the General Assembly in two consecutive sessions–would then go to the citizens for an up-or-down vote. This can be accomplished before the end of 2021. I’ll provide more specifics on this matter as they develop.
Finally, a letter was sent on April 29 by a number of Pennsylvania legislators to U.S. Attorney General Barr earlier this week requesting a federal review of the constitutionality of the shutdown orders issued by Gov Wolf. Images of the letter and the signature pages are attached.
If your state representative or state senator did not sign this letter, please ask him/her why not. All of Pennsylvania's state representatives and half of the state senators are up for re-election this year.
Now is the time to make it clear to them that their position on this is critically important to you. I plan to ask my legislators how their apparent refusal to sign can be reconciled with their oath of office to protect and defend the Pennsylvania and U.S. Constitutions.
So here’s what you can do:
- Visit the Open the States website, sign the petition calling for national, state, and local leaders to end to the Pennsylvania shutdown, and connect with other like-minded patriots in Pennsylvania.
- Go to the COS Action Center, where you can compose a message to your state legislators concerning the urgent need to pass the COS resolutions. If you wish, you can also include a request for them to take action to make it impossible for future Pennsylvania Governors to unilaterally shut down the state.
- Meet with your state representative and senator about the situation in Pennsylvania and the nation, and get them to tell you what their position is on these matters. If you need help getting a meeting set up, pleased let me know.
