During discussion of the proposal, George Mason, delegate from Virginia, posed a question. What recourse would the People have should the Congress ever become hostile to the will of the People? After a short debate, the Framers amended Article V to add a second method that allowed two-thirds of the legislatures of the several States to pass a Resolution calling for a convention of all the States for the purpose of considering proposed amendments. Once 34 States pass the Resolution, Congress must set a time and place for a convention of all 50 States. Because it is a Resolution by the State Legislature, the Governor cannot veto it. Neither the U.S. House, the Senate, nor even the President can block it. The Resolution most clearly represents the direct will of We the People. The Legislature of each State selects the number of at-will delegates to the convention and charges them to stay within the framework of the Resolution, much the same way Electors are selected and charged to perform their duty in the Electoral College. No matter how many delegates are sent, each State only has one vote for any proposed amendment to move forward out of the convention. Any amendments coming out of the convention would then have to be ratified by three-fourths (38) of the several State legislatures to become an Amendment. The resolution has already passed in 17 states and 23 states have passed it in one or their two chambers.
